Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Yufony software ("Software") or connecting to any Yufony seed node, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Software.

2. Description of Service

Yufony is a decentralized, peer-to-peer community chat platform. The Software enables users to create and join communities, exchange messages, participate in voice channels, and communicate via direct messages. Yufony operates as distributed software. There is no single central service that controls all communications.

Yufony ("we," "us") refers to the entity that develops the Yufony client software and operates the Yufony Central seed node (central.yufony.com).

3. Your Identity and Keys

Your Yufony identity is an Ed25519 cryptographic keypair generated on your device. You are solely responsible for the security and custody of your private keys. We cannot recover, reset, or access your private keys.

• If you lose your private keys and have not set up a recovery mechanism (backup key or social recovery), your identity is permanently lost.
• You are responsible for any activity conducted using your keypair.
• Do not share your private keys or mnemonic seed phrase with anyone you do not trust completely.

4. Acceptable Use

You agree not to use Yufony to:

• Violate any applicable local, state, national, or international law or regulation
• Distribute malware, viruses, or any other harmful software
• Harass, abuse, threaten, or intimidate other users
• Distribute child sexual abuse material (CSAM) or exploit minors in any way
• Engage in spam, phishing, or fraudulent activity
• Impersonate another person or entity
• Interfere with or disrupt seed nodes, networks, or other users' ability to use the service
• Circumvent moderation actions (bans, kicks, mutes) through alternate identities
• Use automated systems (bots, scrapers) to abuse the service or collect user data without consent

We reserve the right to ban users from the Yufony Central seed node for violations of these Terms. Community operators may enforce additional rules within their communities.

5. Community Operators

Anyone can operate a seed node and host communities. If you operate a seed node:

• You are responsible for the content hosted on your seed node and for complying with applicable laws in your jurisdiction.
• You are responsible for establishing and enforcing community rules and moderation policies.
• You must not use your access to seed node data (including metadata and, in public communities, message content) for purposes that violate the privacy or rights of your users.
• You should inform your community members of any data retention policies, logging practices, or third-party integrations specific to your seed node.

Yufony does not control, endorse, or take responsibility for third-party seed nodes or the communities hosted on them.

6. Content

6.1 Your Content

You retain ownership of the content you create and share through Yufony. By sending messages through a seed node, you grant the seed node operator a limited, functional license to store and relay that content to community members as part of normal service operation.

6.2 No Monitoring Obligation

Due to Yufony's decentralized architecture, we do not and cannot monitor content across all seed nodes. For E2EE communities and DMs, we are technically unable to access content even on our own seed node.

6.3 Content on Yufony Central

For communities hosted on the Yufony Central seed node, we reserve the right to remove content or ban users that violate these Terms, applicable law, or our community guidelines. We may respond to valid legal process (court orders, subpoenas) to the extent we have access to data.

7. Intellectual Property

The Yufony client software is proprietary. Its use and distribution are governed by its software license. These Terms govern your use of the Yufony service and network, not the software license.

The Yufony name, logo, and branding are proprietary. You may not use them in ways that suggest endorsement by or affiliation with Yufony without prior written permission.

8. Disclaimer of Warranties

THE SOFTWARE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Software will be uninterrupted, error-free, or secure
• Any seed node (including Yufony Central) will maintain continuous availability
• Messages will be delivered successfully or retained permanently
• Encryption will be unbreakable under all circumstances
• Third-party seed nodes will operate honestly or securely

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YUFONY AND ITS DEVELOPERS, CONTRIBUTORS, AND OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF PRIVACY, OR INTERRUPTION OF SERVICE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE OR SERVICE.

Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Yufony and its developers, contributors, and operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Software or service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or distribute through Yufony
• Your operation of a seed node

11. Age Requirement

You must be at least 13 years of age to use Yufony. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have your parent's or legal guardian's permission to use the service.

12. Termination

12.1 By You

You may stop using Yufony at any time by uninstalling the Software and deleting your local data. Since there is no account to close, no further action is required.

12.2 By Us

We may ban your public key from the Yufony Central seed node if you violate these Terms. This does not prevent you from using Yufony with other seed nodes. We cannot revoke your identity or prevent peer-to-peer communications that do not pass through our seed node.

12.3 Effect of Termination

Termination does not affect messages already delivered to other users or stored on seed nodes you do not control.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in English.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top will be revised accordingly. Material changes will be communicated through the Yufony Central community or the Yufony website. Continued use of the Software after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.
